10 years rule

Hi everyone, this is my first post here.
I'd like to know wether I qualify for ILR under 10 years rules, here's my story:
I came to Uk in 2001 overstayed for under 2 years, got married to EU citizen and got 5 years residency as an Eu family member on 08/2003. Divorced on 2006, got married to a british citizen on 03/2008. In 08/2008 applied for ILR as ex Eu family member ( retention of residency) was miss advised by an emmigration lawer. Was told that I qualify for ILR as I lived 5 years rather then applying for 2 years as spouse of British citizen. My application was refused on 08/2010 as it has taken home office 2 years to refuse my case reason being I haven't given them my ex wife's passport?! Appealed and got 3 years discretionary leave on 02/2011.
Do I have a case under 10 year rule? Or just apply for extention to my current leave?
Any thought will be appreciated.

I guess one thing to consider is whether you have any period of overstaying in the last 10 years which break continous residence.
