ILR - How to apply for a 'new' dependet?

Post by nirav.shah83 » Mon Feb 25, 2013 9:08 am

Hello!

I have a Premium Appointment with the PEO office on 3rd April for my ILR application.

My wife is currently not my dependent, she's on her on own Tier 2.

She now wishes to change to my dependent.

Can I include her application in my SET(O) form? Or is that only for 'existing' dependents who qualify for ILR with you?

How should I apply for her?

Thanks!
Nirav

No. To be included in your ILR application, she would need to obtain entry clearance as your dependant (319E(c)) and be in the UK.

Thanks vinny. This is very helpful !

So can I apply for her entry clearance on the same day at the PEO?

Or will that application need to be made separately?

No. Entry clearance is applied for from outside the UK. Your wife would need to retain to her home country to apply.
