ILR and 'accidental' child benefit claim

Post by saraktish1987 » Tue Feb 26, 2013 11:40 am

Hi
I am a South African and so is my husband.

We have 2 daughters, both born here in the UK. I was advised after their subsequent births that I would be able to claim child benefit.

I stupidly did so and was granted it for both girls. I am now planning to apply for my ILR in March.

Will they immediately deny my ILR application on these grounds?

I have stopped the payments and have been told that I may have to pay back the amount given to me. (Which I am dreading.)

I am applying for ILR on grounds of an Ancestry visa. Although my father was born and bred here, funnily enough.

Any advice would be greatly appreciated.

I would like to know if I need to book flights home or pay for my Life in the UK test.

Kind regards and thanks in advance.

I have an Ancestral Visa, I'm not entirely sure what you're asking? I was and am still subject to immigration control, at least until I submit my ILR application.

IF Your Father was BORN Here then YOU should not be here on "UK Ancestry" but "Right of Abode" which entitles you to "Not subject to immigration control" and entitlements to any benefit also you can apply for citizenship directly.

pls see link below:-

Thank you for the reply, but that is something that isn't relevant to me as I was born after December 1982.

When were you born and was your Father British otherwise than by descent? And were your parents married when you were born?

Hi

I was born in August 1987. My dad was born in the UK and my parents adopted me in South Africa. They were married at the time.

I have reviewed all my options and the Ancestral route was my only option.

Do you think there is another route I could have taken?

When you say 'dad' do you mean adoptive dad or biological dad? At the time of your birth, were your biological parents married?

Hi,

Did you eventually pay back your Child Benefit in order to get your ILR?

Your help would be appreciated as my wife is currently in the process of applying for her ILR?

Many thanks

Hi, can you let me know what happened to your case. We are applying for our ILR this year, we are both South African, however we are receiving child benefit for my daughter which was born in the UK. When filling out the form I did tick the box that said immigration control.
I don't know if I should I apply now?
Thank you, any help will be great
