Hello! All,

I need your help with my case.

I currently live in a studio flat and my landlord does not agree to couple renting it. I do not have the Tenancy Agreement(TA) but has agreed to provide one. All the bills(Gas, Electricty, TV Licence) are in my name. That means my wife can’t live with me without a no objection letter from my landlord.

So a friend of mine who rents a 2 bedroom flat, has agreed for me and my wife to take one room in his flat till we find a suitable place of our own. He will provide his TA and a no objection letter. The only problem is that in his TA he has put his child who is 4.9 years old as one of the occupants. The child lives with his mother and only visits him once a week. He says it should not be a problem and that we should explain in a letter the child is under 10 and does not live with him.

I am not sure what to think of it as the TA says the flat is for 3 people. Since the child is considered as 0.5 so in all it will be 3.5 people instead of 3. Will it be classed as over crowding and be an issue with the application? Can someone shed some light on it? Can I go ahead with his proposal ?

Also, these are the documentation, I am about to provide.

My visa type is ILR.
Pay slip and bank statements of 1 year
Savings untouched for 1 year plus current account of £16K+
Wife – ILETS 6.5
Employment Letter
P60
Bills
TA of my friend
Supporting letters from my friends
Cover Letter explaining why I am moving to my friend’s place
Chat /Email/Skype/WhatsApp transcripts
Bank transfer to my wife’s account before and after marriage
Telephone bills calling her number
Marriage certificate
Wedding cards
Wedding photos (group)
Photos before marriage
Honeymoon Tickets
Receipt of Gifts for her

Anymore documents, I need to provide/remove.

Just looking over it quickly, what about the Life in the UK pass certificate?

I don't need have one as I did not need to provide for my ILR (HSMP JR)

Does my wife need to sit for one ? I thought it will come into effect from Oct this year ?

@Isaac01: The OP's questions and his document list logically suggests he's applying for wife's settlement/spouse visa, not ILR.

Knowledge of language and life (KOL) is not required to apply for settlement/spouse visa from outside the UK.

Yes sorry. Got confused by miss reading the first line"My visa type is ILR"
However on a side note I was advised that it always helps to have the LiUK test done as it helps your application.

It's not possible to take the Life in the UK test outside of the UK.

Thank you for all your replies. Yes, one does not require Life in the UK test from outside the UK. I think they are making it a rule from Sep/Oct this year.

I will be applying for a Spouse Settlement Visa.

Anybody has an answer to my query ?

I forgot to add Marriage Certificate, which I have added.
