Approval/Confirmation Letter & Visa Stamp Dates Different, Which one to consider for ILR qualification

I have a question which can be best described by presenting a
scenario and an example, I am going to use figures for illustrative
purpose which are not real but do have resemblance with one of the
cases I know

Applicant switched (within UK) from student category into Tier 1
General, HSMP approval letter was issued in Dec 2007 then applied
to switch from student category into Tier 1 General through
transitional arrangement in place for HSMP approval letter holder
( March 08 )

Background of problem

When received passport + documents from UKBA, letter from case
worker was issued on 17th April 2008 saying got visa for 3 years
but passport stamp says visa valid from 21st April 08 till 7th
April 2011

got extension later on as normal

Question

Does Applicant qualify for ILR (5 year completion)

a) 17th April 2013 (in this case can apply for ILR in PEO 28 days
before which will be around 21st March)

b) 21st April 2013 (in this case I can not apply before 25th March
which is 28 days before)

Please shed some light on the scenario where approval letter and
stamping dates are different and kindly clerify what period is
qualified under i.e. either should consider (in this example) to be
on Tier 1 from 17 th April 08 or 21st April 08?

Applicant have already appointment booked for 22nd of March 13 and
does not want to be taken fee at Croydon PEO and visa refused with
reason to come back after 2/3 days

22nd march is a Friday, 25th is Monday. Why couldn't you wait until Monday?

Hi

Thank you very much for your time to read this example

1 - as I mentioned that these dates are not real, just as an example, actual scenario is that booking is for tuesday / friday in real and finding it hard to get any next close appointment before planed fee increased before 6th April

2 - just curious to know what is general opinion as various people told me that visa stamp date is important and letter date is secondary which I believe is true if you get entry clearance out of UK but our case is within country switch

Hi

I called UKBA this morning and spoke to their representative and they confirmed that I should go by visa stamp/valid from date no matter what is case worker's decision confirmation date is

I was, and, am still 100% convinced that in country applications are counted from decision date and out country from entry date

But anyway, as I have spoken to them so I have to go as they have told, it was not matter of 4 days only, it was matter of how things logically gets counted, just imagine if it was 4 April and 8 April then different fee was applicable
