Hi

I am British Citizen, my non EU Husband has arrived recently with me to the UK. We lived together in Spain and I worked there.
On entry to the UK he was given Stamp Code 1A in his passport, giving him the right to work in the UK for 6 months, within that time he needs to appky for Residence Card.
We're both now looking for work, I just called Job Centre to enquire about MYSELF applying for Job Seekers Allowance. Of course theyve asked me if I have a partner and if he's working and said this:

* As you may be eligible to claim the income-based component of Jobseeker's Allowance, your partner must agree to your claiming benefit for him/her. Does your partner agree to your claiming benefit for him/her?*

Apparently theres no way I can apply for Jobseekers Allowance for myself only. Im concerned about applying also for him, as this would efect his applicatoin for Residence surely?
Can anyone please advise on this? We are desperately looking for work and will jump at the chance of a job, so the time spent claiming will be minimum. But will this effect his Residence Application in a few months?

I cant apply for myself only in the other category, as I 'had to have been paying tax and NI in the UK for the past 2 years' ... and I was in Spain...

So the only option is to apply as a couple.

Any advice would be appreciated!!!

he doesnt HAVE to apply for RC. although it is wise to do so.

the code 1A stamp is proof that he entered the UK legally.

his rights do not expire.

he can legally claim JSA with you, however im not sure of the implications of you claiming jsa long term might be... (his Code1a stamp doesnt state no recourse to public funds right?)

short term it might be an idea to find a job ASAP yourself, and apply for his RC then. however, since your applying under surinder singh, its your work history in spain that is in question here, not what your currently doing in the uk.
