Tier 1(General) unpaid absense for ILR

Hi,

Apologies, if this query is repetitive but I searched through existing posts didnt find similar situation as that of mine and hence posting this query to seniors and experts. I appreciate your suggestion and valuable answers.

I'm on Tier1(general) visa since July'2008 and I'm eligible for ILR in June'2013. I have query related absence from UK. I had been out of UK for 7 times ie 7 trip and total absences is 170 days in last 5years, out of which 107 days are unpaid holidays(this is due to job situation and all these absence between job change) all these absence to visit family to back home country.

The 107 days unpaid absence covered in 4trip ie
1) April 2009- May 2009 - 15days Unpaid(no job)
2) June2010 - July- 21days unpaid (no job and my wedding), came back to UK
3) July 2010 - Sept 2010 - 41 days unpaid (no job)
4) Feb 2011 - March 2011 - 31 days unpaid (no job). So total unpaid holidays are 107 days. Overall absence in 5years is 170days.

What reason do I have to mention in my ILR application related to my unpaid absence?, does this unpaid absence would be considered by case worker? or do I need to approach solicitor for my case

You are allowed 180 days PER YEAR.
They cannot expect you to justify everything by employers especially if you were "between jobs".
Just write : Between jobs or Job seeking + vacations.

I am just guessing but it should be ok.

Absences due to the applicant travelling to see family and friends whilst unemployed would break the continuous period for ILR, as they are not work-related or for compelling or compassionate reasons.

I'm little worried :(, Any advice please

As you are on T1G it is not necessary to provide an explanation for any holidays (unless > 180 days). Just say "Holiday" as reason for absence.

If you are self emplyed with limited company. than you can mention easily that you were on holidays. No need to worry but if you were in permnent employement, than it might be a issue. But still you are under 180 days so no worries for you. Just mention it as holidays.

I was and am permanent in job. Absence was due to redundancy and job changes
