Travel with ILR Status

Post by abmnerang » Wed Feb 27, 2013 5:09 pm

Hi,
Could somebody please advise if it is acceptable to travel for 8-9 months away from UK with ILR status and return to UK after these 8-9 months without any issues.

and also (apologies if this part of question should not be posted in the same topic) if our baby who holds red passport travels for the same 8-9 months away from UK, we are assuming that it should not matter as he holds red passport.

basically a parent with ILR status with a baby with red passport can spend 8-9 months away from UK and won't have any queries while their return to UK

please advise.

many thanks,

Those with ILR should not have any issues providing they are not out the UK for 2 or more years. Though, to save any issues it may be advisable to not stay out for longer than 18-20 months. Though up to 2 years should be fine. British citizens can travel out as long as they wish though, for benefits they may not be habitual residents on their return but no immigration issues.

It will only impact your British citizenship application as you will have to wait for another year(90 day rule). But if applying BC is not your priority at the moment then it's all good
