Tier 1G to ILR

Hi,

I have tried to search for an answer for my question on this forum, but couldn't find one. This might be a different scenario. Apologies if this is a duplicate request.

I have received my first tier 1 gen visa in Dec 2008; however, I only entered the UK first time on 27th Jan 2009, which is almost a month and half after I received my visa.

My visa is set to expire in Dec 2013, leaving short xx days for extenstion to ILR (which I think).

I have made only 25days of unpaid holiday and 70 days of paid holidays to India since I enter the UK in 2009.

My question :?: is I am I meeting the 5yrs criteria. I am eligible to apply for ILR in Dec 2013 or should I apply for another Tier 1 Extn then once I meet the 5yrs criteria only then apply for ILR.

My stay in the UK:

Entered the UK - 27/01/2009
Visa set to expire - 02/12/2013
Total stay - 4yrs 10months 5days

Holidays made - 25days unpaid and 70 paid
