MN1, MY DAUGTER IS AWAY FOR 1 YEAR, IS SHE STILL QUALIFIES

Post by jaya_jc » Fri Mar 01, 2013 11:10 am

can someone please give me suggestion for the below senario.

My daughter born in this country in 2005, but she has to go to india for 1 year ( july 2009- junu 2010), she came back in june 2010, and since she never been to any other country, i got ILR in FEB 2011, and British citizen in june 2012, can i apply for registration as british citizen for my daughter, as i read somewhere that she should be in the country for 3 years, child should not have been absent for more than 270 days in the three years preiod,

just i wanted to know wheather she qualifies or not if i apply now for british citizenship.

She can apply now. There are no residential requirements for application under section 1(3) (children born in the UK).

The 3 years / 270 days apply for children born abroad to parents who were British by decent at the time of the child birth. This doesn't apply in your case.
