Family Visitor Vs General Visitor

Post by poper » Fri Mar 01, 2013 2:32 pm

Hi Members

I am on a Tier 2(ICT) visa since Sep 2010 and would like to invite my parents to the UK from India for < 6 months.
My friends have advised me to apply for a visa under Family Visitor category. Having gone through the below page I am confused -

http://www.ukba.homeoffice.gov.uk/visas ... uirements/

Additionally the family member you are visiting must :

be a British citizen;
be settled in the UK;
have been granted asylum in the UK; or
have Humanitarian Protection status.

I am not a British citizen nor am I settled in the UK. Does this mean that my parents need to apply under General Visitor?
My friends on Tier 2(ICT) had gone for a Family visitor route for their parents.
Is it that the immigration rules have changed recently?

Thanks
Poper

I wonder what is causing your confusion? It clearly states that family visitors must be visiting qualifying relatives who are British or settled. Settled means having a permanent residence status that is not subject to expiry. You are a PBS migrant worker with temporary leave to reside in the UK. As a person with a temporary migrant status do you consider yourself to be British or settled in the UK?

Thanks for your response.
The point on British/Settled status is clear.
My confusion was why/how my friends on Tier 2(ICT) had gone ahead with a family visitor visa process for their relatives and succeeded. I was being advised on the same as well.

Thanks

You ask why: it could be an error or an application made some time ago, before the family visa conditions changed.

This forum is not a quiz show and nor are the people who contribute detectives looking for clues and hoping to exercise their craft; if you have information you should give it. Asking this in the context of your friend's experience is relevant and should have been revealed from the outset.
