SET(O) returned due to wrong application fee (CESC)

Post by quaternik » Fri Mar 01, 2013 5:04 pm

Hi,

I have recently applied for the ILR using the 12/2012 SET(O) form which is still the same on the UKBA website as I write this. Being from one of the CESC countries and applying as a Tier 1 (general) migrant, it was indicated in the form that I should fill in page 5 for the payment, not the page 4. That means £893 instead of £991.
My application was received on 11th Feb 2013, my card credited the next day, for £893, and the application was sent back on 20th Feb, with an unsigned cover letter claiming that I had paid an incorrect fee. It also says that the money would be returned shortly, although I haven't received it yet.
The letter does not specify which fee I should have paid, it simply says that the fees have been set in April 2012. Has anyone had a similar experience? What is the correct fee for CESC nationals?

Regards

You should have filled payment details on page 5? Is that what you have done?

Yep. And as I mentioned, they credited my card for the amount specified on that page.

As per the form, you should have filled in page 5. Not sure why they sent the application back if you have filled in payment details on page 5

That is what the lady on the helpline said too.
I started thinking that they discontinued the CESC rate for SET(O) recently, since I can't find it on the UKBA website anymore, but the form that is still there has not been updated.

The question is, do I reapply, fill in the page 4 and tell them that my previous application in which I filled the page 5 was sent back? What other options do I have?

To get more clarity, what does the unsigned cover letter sent by Home office exactly say?

OK, I've typed it out below. The form I applied with is the one currently downloadable on their website, 12/2012.
APPLICATION OR CLAIM IN CONNECTION WITH IMMIGRATION

Thank you for your attempted application for Leave to Remain in the United Kingdom

Changes to Application Forms and Fees

Please note that with effect from 6 April 2011, the fees for the purpose of your application have been subject to an increase. Applications made on or after 6 April 2012 will need to be accompanied by the new fee, even if made on the current version of the application form. Please visit our website www.ukba.homeoffice.gov.uk for further information.

For reasons set below, your application is invalid and we are returning the application form and documents received from you. Please read this letter to ensure that you understand what you need to do in order to make a valid application.

The specified fee has not been paid in connection with your attempted application which you made by post on 11/02/2013. We do not consider that an exception to the requirement to pay the fee applies in this case, and therefore your application is invalid and we are returning your documents.

The passage next to the box ticked below provides more detail about the failure to pay the specified fee and the steps you should take to ensure that you make the correct payment when returning your application.

[] Although a payment has been made, it is not the correct amount and will be returned shortly. you must pay the full amount when making your fresh application to the address given on the application form.

You have paid an incorrect fee.

Where an application form form has been specified in accordance with the Immigration Rules (HC395), the application or claim must also comply with requirements set out in paragraph 34A of these rules and The Immigration (Biometric Registration) Regulations 2008. The relevant requirements are listed below, a cross in the box indicates that a requirement is not met. Where a form has been specified in connection with an application form or claim, a failure to comply with these requirements will mean the application or claim will be invalid.

The application or claim must be made using the correct version of the specified form. you can obtain forms from our website at www.ukba.homeoffice.gov.uk.

Making a valid application, that is, one on the correct form which complies with the above requirements does not guarantee the application will be successful. The application will be considered on its own merits and where appropriate, in accordance with the Immigration Rules and published policies. If you require further advice about your eligibility under the Immigration Rules, please visit our website at www.ukba.homeoffice.gov.uk.

If you still wish to make an application, you must return your fully completed application form with the appropriate fee to the address given on the application form.

Fee went up in Oct 2012 the last time from £875 to £893 for CESC nationals looking to apply by post so this means the form is updated. Is there any contact number or any other details which helps you to contact them?

Strange!

No contact number. No reference, just Case ID and date. That box that is supposed to be ticked, it isn't. There was space left at the bottom of the letter for the signature, between Yours sincerely and the typed name, without a signature.
This sort of thing makes you start doubt yourself. I got Tier 1 and Tier 1 extension without any problems, each took about 4 to 5 weeks. I never expected to trip up on one of the rare unambiguous things in SET(O).
