ILR help !!!

Post by davemob » Sat Mar 02, 2013 8:57 pm

I came to the UK on a Sole Representative visa:
Got visa from India on : 02/07/08 to 02/07/09
(12 months)

Switched to Tier 2 general visa on
28/07/09 to 22/03/2011
(20 months)

Switched to Tier 1 general visa on
from 22/03/2011 to 22/03/2013
(24 months)

Got an extension now till 2016 basically.

Now as I need to apple for ILR, I have few questions:

1) So basically will I be eligible for ILR 02/06/2013 ?
2) Now when I extend my visa from sole representative ti Tier2 General, I had to go to India for entry clearance, i was in India for 30 days basically so is this a problem ?

Can someone please help me calculate when I am eligible for ILR many thanks in advance. I don;t think so I have been out of the country for more than 180 days in any of the 12 months during these 5yrs.

245DC(c)

You can't aggregate the SR leave into your five year settlement period when applying as a Tier 1 migrant. You are eligible for ILR at the end of June 2014

Well it clearly says here
http://www.ukba.homeoffice.gov.uk/visas ... ettlement/
That you can apply for ILR at the end of the period as a Sole Rep
Can you pls suggest on what bases you are confirming this ?
Also, when I was under sole rep visa it did lead to iLr unless the laws have been changed now..

Yes, but from what you have stated, you are not applying for ILR as a Sole Rep, but rather as a Tier 1 General Migrant. You are not allowed to combine your residence as a Sole Rep + T2G + T1G towards your ILR residence period if applying for ILR as a T1G Migrant. Reading the immigration rules for that immigration category would help you understand this.

See 245CD(c). Requirements for indefinite leave to remain
