2 questions, I applied for ilr (long stay) 6 months ago last week, but have not got any reply. I will be sending flr(m) forms for my dependants as adviced but I have a son who is 5 years and was born in UK. I am told if my application was successful and ilr granted, then his application would be a separate on from flr(m) which is MN1.
-My question is: is this the correct form (NM1) and procedure to follow?
-Should I fill the form NM1 and send it together with for those 2 other pendants who will be using form flr(m)
-Please on accomodation, I have 2 children, a girl and a boy, 12 and 5 respectively and we live in a 2 bed house, would this have an effect on the outcome since they may require both to have separate rooms

Does your son hold any dependent visa? If not, don't worry.

The dilemma here is:

Your dependent's FLR(M) won't be approved if your ILR fails.

(1) If your ILR is successful, your UK born son's dependent visa becomes instantly irrelevant as he his immediately ENTITLED to Register as a British Citizen under Section 1(3) of the BNA, and MN1 form or the Registration process does not question your UK born son's immigration status.

(2) If your ILR fails, then probably you would appeal, in which case your Dependents FLR(M) application would remain undecided, and they are covered by section 3C. In the meantime, would they ask your son to leave the country if he did not have a pending UKBA application for his Section 3C leave eligibility? Very unlikely.

(3) Third scenario, your ILR is successful, but your dependent's FLR(M) is refused, and you appeal. But, as in para 1 above, your UK born son doesn't need to wait for FLR(M) decision.

The only benefit of including him in the dependent application is to give his 'stay' some form of legitimacy until you get ILR.

Very tricky.....
