I read here on Immigrationboards in the topic "Citizenship FAQs - Common Questions"

In the Q5... (If you hold a PR Confirmation for less than 1 year but have lived in the UK for 6 years, you can apply using option (1). The PR confirmation can only be used if you apply 1 year after the issue date.)

well i have lived in the UK for 8 years and I have the proof I was with my partner for this period we got married just 3 years ago but as i had proof we are together for a long time i got the pr last year.

so, i called to the Nacional checking service to book and appointment and they said Its wrong and I cant do it. I could if i was proper married for 6 years or if I have the PR for more them 1 year.

I think they are wrong, but what can I do?
Anyone can help me?

The FAQ is not 100% accurate (I can only blame the author...).

Rights under EEA regulations are obtained automatically if you are married/CP. If not married, your time under EEA regulations starts when the HO acknowledge your relationship and issue you a RC.

ohh cool. But in that case our previous discussion you were wrong because I have the permanent residence they gave me and i was right

all I said was
If you didn't have a RC and this time was recognised for your PR application, count yourself lucky as similar applications have been refused. If this is the case, I would wait for 1 year after the PR issue date, as you don't want the HO to decide to go by the book when they evaluate your application again and there is £850 at risk.
I stand by my view. Other people in similar cases have been fighting the HO to get their time before marriage recognised without success (yet). Going by the book, time before marriage without RC should not be counted for PR/BC. As I said before, I would wait and not risk the £850 fee.

You can insist that NCS accept your application. Tell them you are willing to take the risk (they will ask you to sign a form stating that) or send your application by post.

yeap I know what u mean i will wait its just for months until it be 1 year with the PR don't worth loosing 840£ like that. but when i have 1 year PR will I just apply with my documents and not with my partners?

Correct. If you apply 1 year after PR all that you need is:

* Passport (with PR confirmation).
* Life in the UK test.

Nothing else.
