min qualification level for Tier 2 swtiching

min qualification level for Tier 2 swtiching

just wondering what should be the min job level for a person who is already in Tier 2 G and want to switch to Tier 2 G with another sponsor.

according to UKBA website,

at S/NVQ level 4 or above if the migrant is already in the UK under Tier 2 (General), Tier 2 (Intra company transfer) or a work permit if that permission to stay was granted under the rules in place before 6 April 2011; or
at S/NVQ level 3 or above if the migrant is already in the UK under Tier 2 (General), Tier 2 (Intra company transfer) or a work permit if that permission to stay was granted under the rules in place before 6 April 2011

The migrant must be paid the appropriate salary or other remuneration package for the job in the UK.

but both paras seems to be the same unless I cant find the difference. does one mean to say before and after 6th April 2011.
