i have applied as an unmarried partner under FLR(m) in October 2012. I have just received a letter saying that I need to provide my partner's "audited accounts". He is a sole trader earning less than £15000. we had asked a lawyer before we applied who said this was not necessary since he has a small business. So does this mean we can submit unaudited certified accounts instead? I plan to write a letter to the case worker tomorrow, so was hoping to quote these notes to claim exemption for auditing.(i) (aa) If the applicant's business is a registered company that is required to produce annual audited accounts, the latest such accounts; or
(bb) If the applicant's business is not required to produce annual audited accounts, the latest unaudited accounts and an accountant's certificate of confirmation, from an accountant who is a member of a UK Recognised Supervisory Body (as defined in the Companies Act 2006);
If we doe this now, the date on the certificate will be the current date as we didn't do this before we applied. Will this matter?
They have also asked for a profit and loss report, and we'll ask the same accountant to do this, so this will also have the date issue.
Also, they seem to have lost a document I sent. I mentioned in my application that I would send this shortly, and did so, but they are asking for it again. Annoying!
