ILR OR FLR?

ILR OR FLR?

hello i think i am in trouble..i have sp30 2 months back and 5 points and £240.00 fine via magistrate court.My ILR is due in 25 days time..please help me what should i do as per new rule i cant get ILR for 2 yrs is that true? if not what should i do my visa exp on 15th april 2013 need help guys..should i take risk ..it was speeding offence but i had everything licence,insurance MOT ..what should i do please help..should i apply for ILR (is it risk for lossing ILR fees?..is sp30 speeding offence count in criminal offence..need help early..thanks

Why did the fine go to the court? Did you not pay it on time?

due to high speed i had court summon..i did pay in time but it was not FPN..been told due to high speed it will directly deal in court not via FPN..it will be a problem isnt it for my ILR?

Highly unlikely it will go through.

There has been a case where a speeding offence through the court within last 24months but it went to court due to late payment.

You are better off waiting for 2 years or if you really want to take a risk, look for an appointment at Solihull PEO where atleast you don't have a risk of losing money as they decide case first and then ask for payment

Thanks for reply Gagan..i already took an appointment at Croydon as i was not aware of this but i can always cancel it...is Solihull PEO is same as Croydon ..how will it work..bit more advice please..is it same like taking ILR appointment online..

Yea you can book it online. If you have already booked one online for Croydon, you can reschedule it without losing the one for Croydon.

If you manage to change it to Solihull, then you cut the risk of losing £1377. I mean if in Solihull they decide you are not eligible they will send you back from there itself and won't charge you.

Thanks Gagan..i just tried but not getting appointment before my visa expire..i think i should wait as dosent look like i will get it my bad luck..so in this case should i apply for FLR?..is it visable to do this as my visa expiring next month..for FLR do i need to take appointment same way as ILR?

For Solihull appts you have to start searching from around midnight to 2am' ish. You will eventually find one no problem

It is unlikely you will go through, but you can still try at Solihull, where you will be told whether you will be refused or not before paying for it.

Thanks for info..i managed to book my appointment in Birmingham ..does that mean no matter what happen i wont loose my money..so even if they don't give me ILR they wont charge me anything for sure is that correct?...another this i want to confirm is if i don't get ILR do i need to go for FLR (O) for next 1 and half years till my convection spent..is that correct?..i applied for my CRB waiting for that..any suggestions please..i will appreciate all guidance and help..

Thats correct and make sure you declare it on the form, so CW is aware of it before he asks you to go for payment. If you are asked to go and make payment this means that the offence wont be a hindrance to your application getting approved(subject if you have other problems in your case)

if it gets rejected, you have to apply for extension of your current visa you are on

Thanks for reply..yea by reading all other cases i think its very unlikely i will get ILR but at least i am not risking money..by the way my CRB came today and came clear but i dont think it will help..i am going Birmingham next month
