Hi Gagan1986,
Can you please tell us, during your employer licence renewal process, if you had any visits from UKBA and what documents were requested for renewal..Regards

Though they say renewal takes 15-20 days it took good 7 weeks for us. My HR got that sorted for another employee so not sure what docs were used.

Don't think so, your sponsorship licence is not valid until it is renewed hence you won't be able to issue a COS

Hi All,

I am in tier 2 visa which expires on March 2017. But I just came to know that our Employer sponsor license have been expired. My employer told that we haven't got any formal notification regarding the license expiry. Also they are in process of renewing the license straight away. Will that be any problem to me? Because UKBA says that

If your sponsor’s business is taken over or they don’t renew their licence
Your visa will be limited to 60 days (or however long you have left on the visa if it’s less than 60 days) if:

your employer doesn’t renew their sponsor licence
following a takeover of your old employer’s business, your new employer doesn’t apply for a sponsor licence within 28 days
You’ll have to leave your job and leave the UK unless you make a new visa application within that time - check your eligibility for visas.

60 days cooling period is for applying the license or to get the employer license?

Please help,

Thanks in Advance.

This is not an uncommon issue.
Expiry is no longer notified and it is upto your Sponsor to keep on top of it, hence there are Sponsors failing to apply to renew on a regular basis.

As long as the Sponsor is taking action to address the issue even after the time limits UKVI usually are pretty good at allowing a renewal application as opposed to insisting on a completely new application.

As long as you have not received a curtailment letter because of the expiry it should be ok.

No reminders at all not even for Tier 4 BCA licence...
Stance is that PBS is on its third round of renewal this year, Sponsorship is not a new system anymore and Sponsors have the responsibility to manage their licence. If they miss the renewal then tough really.....

Is the company name removed from the sponsor list, when the company sponsor (tier 2 general) license goes for a renewal?

The Authorising Officer at the sponsor's office IS sent at least 2 (possibly 3) reminders about imminent sponsor licence expiry, starting several months from the expiry date.

Some sponsors don't keep their AO details up to date, so the AO may have left the company and the UKVI are not aware so they still use the old email address. That is a failing on the part of the sponsor.
