Hi,
I want to know how many years I can get visa extended.
Initially came to UK on WP - 07-Dec-2007. Visa validity – 12/11/2007 to 01/07/2008
Got extension in UK WP – Mar 08, Visa validity – 16/06/2008 to 31/03/2009
Got Tier 2(ICT) as extension in UK – Mar 09. Visa validity – 18/03/2009 to 11/03/2012
Got Tier 2(ICT) as 2nd extension in UK – Jan 2012 Visa Validity – 10/02/2012 till 5/01/2014
I want to know, can I extend 1 more year or more? Is there any restriction on extension after Jan 2014?

Its been over 5 years why can't you get ILR ?

I had gap of 4 1/2 months in Aug 09 - Dec 09.
I am not getting employer letter for the same.

Hmm...I don't get it. Is your employer Indian/Pakistan? I have seen people getting letters quite easily.

I work for one of the top Indian company,
When we finish with assignment, need to go back to India , as I am India based employee.
I worked on another project in India.
I am with the same employer all along.

I have heard from many applicants who are on ICT that their employers do not support them for ILR, TCS being one of them

True, because employers knows they will loose employee once employee gets ILR. They don't pay according to market rate.

When I went for my PEO ILR appointment, I met a guy there who came to apply for ILR under tier 2 ICT and his case was the same.
He did a smart thing of not telling employer and got a generic letter explaining absences and staying SOC codes( requirement for ILR) and told his employer he is applying for extension. His ILR was approved the same day

I will also get generic absence letter from employer with SOC code.
As I know employer letter should explain
1. why they sent me back to India,
2. Why that was necessary
3. If I wouldn't have gone back to India then what would have been impact on business.

My absence wasn't more than 180 days in a year any time.
Year 1 08 December 2012 07 December 2011 >> 0
Year 2 08 December 2011 07 December 2010 > > 14+14 =28
Year 3 08 December 2010 07 December 2009 > > 30
Year 4 08 December 2009 07 December 2008 >> 152
Year 5 08 December 2008 07 December 2007 >> 31+4 = 35
My only concern is with 152 days in year 4, b'cas I was in India and paid in UK. I wasn't paid Salary, NI/Tax in UK.

I didn't have P60 until April 2011, B'cas company used to manage through Group Tax and we used to get tax free salary in UK + Basic and allowance in India.
All Indian companies used manage the employee tax as Group Tax than individual employee tax.
in our company, I hope it was same in all Indian companies that time(i.e. until Apr 2011). Every employee who comes to UK, he will get tax free salary for first 2 years. I didn't had my NI card until Feb 2011.
