ILR help needed

I've a couple of queries related to ILR application which I need your help on.

My background is as follows.

1. I had a work permit from 15 Dec 2005 to Dec 2010, I worked in UK from 1 Jan 2006 to 28 Feb 2008 and then went back to India.

In March 2010 I applied for Tier 1 visa and got it on 13 Apr 2010 for 3 years. I travelled to UK on 4 July 2010 and since then I'm in UK.

I'm now applying for extension on 28 Mar 2013 through PEO.

My queries are as follows.

1. As I entered UK almost 80 days after I got my visa, will it be calculated in my ILR visa application (5 year residence) ? I know of the 90 day rule, I'm only confused as I had a work permit earlier.

2. Will my Visa extension will be stamped from 13 Apr 2013 as I'm applying within 28 days

Please reply ASAP.

Yes

It should be stamped from 13th April however, you should not be worried about the extension start date but the end date as that is the one which should be stamped till 13th April 2015. You can discuss with CW on the day however, I feel you will be safe.

Subject to approval, your extension will be stamped from 28th March 2013 till 28th March 2015

Hi Gagan,

I don't think that is correct as hi maar got the visa stamped from 13th April initially.

I applied 7 months before expiry of my HSMP visa and got it stamped from the date of the extension to the end of 5 yrs effectively I got the extension for 3 yrs and 7 months.

Hence, I think having a diaglogue with the case worker is the key.

Agree with you uksettlement. Having a Talk with the CW is a key in many situations. Ability to explain clearly and simply. Of which Gagan is an Expert.

Very true, giving CW but of a chat is the key. My mate got his extension last month and he applied for extension a month before its expiry as he had to travel, he was given an extension exactly 2 years from the date of approval. But it happened with you so there seems to be a grey area how they are dealing with these extension. Thanks for the feedback, appreciate it
