Dependant fund requirements

Post by amit23 » Fri Mar 08, 2013 1:52 pm

Dear All, I am planning to bring my wife to UK. I am on a Tier1 visa and employed in UK for more than 2years...Could someone please guide me through the fund requirements needed to be maintained to bring your dependent? Surprisingly everywhere on UKBA site it only talks about maintaining £600 maintained for 90days period for your spouse..however do i still need to maintain funds of £900 for myself? if yes, for how long?

Options1:
£600 only for dependent?

Option2:
£600(Dependent) + £900(Tier1 holder) = £1500

Which one?

Thanks
Amit

explanation is mixed on UKBA which explains as you may only have to maintain 600 for 90 days but I will suggest to be on safe side and keep 600 + 900 for 90 days and then apply within 30 days of the bank statement. My personal experience was always like this and never had an issue

It is £600 if dependent apply separately after main applicant got his extension.

Hey Amit,

If you are in the UK for more than 12 months, the ans is Option.

akan you have to show maintenance funds of £900 for yourself as well regardless of whether you apply with the dependent or separately

Point 44-47 on page 8 explains clearly.

Gents ... I have explained you in other post that point 46 says clear

''For example, the Tier 1 Migrant has been in the UK for 6 months and is making an application at the same time as their spouse and two children. They must show that they have £1800 for his spouse and a further £1800 for each child, in addition to £900 required for their own support. In total the family will require evidence that they hold £6300 in available funds (£1800 x 3 = £5400+£900). ''

If main applicant is applying same time as dependents only then £900 need to show and this is also confirmed by Forum Gurus .

Please don't confuse people.

Amit its £600 only .... You have my word on this.

Please refer to appendix E of the immigration rules.

Hi,

CW are expected to go by the rules and if possible check up on the guidance in case of any doubts/concerns. Unfortunately there can be discrepancy between the Immigration Rules & Guidance. So lets assume as per Rules the requirement is just £600. The following can happen:

1) The CW might use the guidance and then possibly reject the dependent Tier-1 Visa.

2) The CW knows the rules of book and will issue Dep T(1)G visa.

If option 1) happens then sure, you can either re-apply or put an appeal within 28 days. The point is the time consumed to get over the appeal and paper work etc., which in hind sight (actually fore-sight) might be better option to apply with £600 + £900 (i.e) as per guidance.

@ Akan: The beginning of Appendix E goes like this : (aa) Paragraphs 1A and 1B of Appendix C also apply to this Appendix.. This means when interpreting Appendix E one should also apply Paragraph 1A & 1B of Appendix C. The Paragraphs are given below:

1A. In all cases where an applicant is required to obtain points under Appendix C, the applicant must meet the requirements listed below:

(a) The applicant must have the funds specified in the relevant part of Appendix C at the date of the application;

(b) If the applicant is applying as a Tier 1 Migrant, a Tier 2 Migrant or a Tier 5 (Temporary Worker) Migrant, the applicant must have had the funds referred to in (a) above for a consecutive 90-day period of time, unless applying as a Tier 1 (Exceptional Talent) Migrant or a Tier 1 (Investor) Migrant;

I think the answer should be clear now.
