Hi all,
I have read all the application guidelines, Guide AN, and information on the UKBA website regarding eligibility for citizenship. I am a little unclear about one issue and am hoping that members can help me.
I plan to apply for BC mid next year. I need to work out the timelines now because I am going to be out of the UK late next year, and I need to make sure I can meet the requirement to attend a czp ceremony within 3 months. Hence planning so far ahead (which may seem a bit silly).
My question is about the rule that "You must not have had more than 90 days outside the United Kingdom in the 12 month period before making the application". I want to know whether you can split this. To explain, here's my timeline...
27 July 2011 Obtained ILR after 5 years continuous residence
18 October 2012 Left UK, plan to return 5 May 2013 = 199 days outside UK
10 April 2014 - plan to apply for BR. (nb was physically in the UK in April 2009)
Now, I meet all the requirements (no more than 450 days out of country in preceding 5 years, and ILR for at least a year preceding application, present in UK 5 years prior to receipt of the application). What I am unclear on is whether I meet the 90 days requirement. In the above example, in the last year preceding application, I would only have been out of the country from 5 May to 9 April 2014, so less than 90 days. Does it matter that this was part of a bigger absence (199 days)?
I hope my question is clear enough! Thanks in advance for your help.
