Citizenship Application query-Only one parent eligible

Post by hionesecond » Sun Mar 10, 2013 9:10 pm

Hi all,

looking for some advice here.

Myself and my wife have completed 12 month on IRL and want to apply for citizenship with my child who was born abroad.

As the rule states, you need to be physically present in the UK 5 years (3
years if you are married to or in civil partnership with a British citizen) before the date that
the application will be received by the UK Border Agency or other receiving authority.

Based on this rule, I am eligible to make an application now as I was in UK but my wife isn't as she was in India for the birth of our child and they returned back to UK six months later.

In this situation is it best for me to wait further 6 months and apply for all 3 of us together?
OR
I submit the application just for myself and do it for my wife later.

If I apply, then can I apply for my child along with my application or do I need to apply for my child along with my wife.

If I apply and I gain citizenship, will there be any change in the eligibility criteria for my wife. Like present in UK for last 3 years instead of 5 years?

Any advice much appreciated.

thanks.

your choice. If you wait and apply together, you pay a joint fee and save about £200.
If I apply, then can I apply for my child along with my application or do I need to apply for my child along with my wife.
Your son can apply with you.

Correct. If your application is approved, then once you attend the ceremony you become British citizen and your wife can apply under the 3 years rule.

Hi Jambo,

Thank you for getting back.

I was going thru the Guide_MN1 document and it mentions the following:
Children born abroad to parents who are applying for British citizenship
Where one or both parents are applying for British citizenship they may apply for one or
more children who are not automatically British at birth (see “Automatic acquisition of British
citizenship” above) to be registered as British citizens as part of a “family application”.
Children in this category will be considered at the Home Secretary’s discretion and will
usually be registered only if both the parents are granted or already hold British citizenship,
or if one parent holds British citizenship and the other is settled in the UK.
Does this mean I cannot apply for my child along with my application?

Thanks.

On the contrary, the last sentence is exactly your case - once you are approved, you will hold BC and your wife would be settled (ILR).
