HSMP Judicial Review - ILR & Partner visa

Post by richard2013 » Mon Mar 11, 2013 9:40 am

I have a question about possibility of my partner getting a visa/ILR/FLR connected to my ILR status.

I entered the UK on 12.9.2005
Obtained HSMP circa October 2006 (ie. subject to Judicial Review case)
Extension granted February 2010 for final 2 years (visa stamped as Tier 1 extension)
ILR granted on 16 February 2012

My partner is Colombian and currently here on a post-study visa.

Having read some other posts here, is it correct that, because I am subject to the Judicial Review ruling:
1. She is regarded as a "dependant"?
2. She can obtain ILR or perhaps FLR that is liked to my status ?
3. No evidence of 2 years (or otherwise) past cohabitation is needed?

If the above is correct, what status can she apply for, what form is appropriate, and lastly does any intention of future cohabitation need to be demonstrated?

Any advice whatsoever on this scenario is greatly appreciated.

many thanks.
