child born in the uk expired visa can apply mn1

hi guys i have applied for my ilr in september and have not heard anything yet my daughter was born here and she is 3 year old i have applied for her visa in 2010 and now her visa is gonna expire this month i wanted to apply for her mn1 after my ilr. does she need to have valid visa to apply for mn1?can i still be eligible to apply for her with an expired visa?please help me guys i am so confused
