Tier 2 Visa Refusal and Appeal

Hi

I had applied for Tier 2 Visa on 07th January 2013, while on a Student Visa which expired on 24th January 2013.

Today (11th March 2013), I received a refusal letter for my Visa Application and it was refused on the grounds of Appropriate Salary. My employer had mentioned wrong Job Title (the main job code is correct) on the Certificate of Sponsorship.

Now UKBA have retained my Passport and Documents and have sent me a form to APPEAL.

I am confused what I must do now.

1. My employer is applying for a new CoS with the proper Job Code.
2. How and When do I get my Passport and Documents back from UKBA.
3. I am going to Appeal to the First - Tier Tribunal saying that my employer has applied for the CoS with the inCorrect Job Title. What are my Chances?
4. Since my Student Visa expired on 24th January 2013, and I received my Refusal Letter on 11th March 2013, from when am I considered as being overstayed.
5. Instead of appealing, can I re-apply with the new correct CoS (Note: my passport and documents are with UKBA).
6. How many days does it take for the court to decide on appeal.
7. What is the best course of action that I must take.

Could anyone please help or guide me through.
