Refusal because of Inappropriate Salary (i though it was)

Hello,

I ve got my refusal with right to appeal this morning.
They said my salary is not appropriate.

Me and my sponsor always thought that 27000 per annum for 40 hours per week is enough. But they said under my job category it should be min 26000 for 37.5 per week. After the calculation my salary becomes 25300 for 37.5h per week.

In this situation can I make an appeal? My employee is alright to increase my salary. But i cannot make a new application (i guess?) as my visa expired in January 2013. Can i make an appeal saying that my employee is willing to pay more? Or can i said it was a mistake, didnt know it was 37.5h per week and i will get 27000 and work 37.5h per week.

Can someone suggest me what to do?

Also it says return this appeal in 5 days if you are detained. What does that mean, i have no criminal issue so I am guessing I am not detained, am i right?

just to make it clear,

Do I have a chance to win the appeal in a situation where my salary is calculated wrong (by me and my sponsor) and stated 770 pounds less than it should be?

My visa expired in January, if i dont have a chance in the appeal, can i apply inside the UK or should I go back to my country and apply again?

Confused u said ur visa Expire in JAN but u posted this on Tue Mar 12, 2013 2:38 pm ??

i couldnt re apply because i was switching from tier 4.

I will lodge the appeal tomorrow with a solicitor..
