New 5 Years ILR Restriction on old applicants

Post by shieldguy » Tue Mar 12, 2013 10:40 pm

Hello my wife came to UK March 2011 under Tier 1 General Dependent, I was on Tier 1 General at that time, on Aug 2012 I got ILR but my wife visa was expiring and I cant apply for her ILR because she has not completed her 2 years in UK at that time so I applied under FLR (M) as ILR spouse now we got Flr (M) application accepted last week but they say my wife have to show total 5 years stay in UK rather than 2 years before she can apply for ILR according to July 2012 new rule, but as far as I know these rule shouldn't apply to her as she was already in UK under Tier 1 dependent before the July 2012

Please advice what should we do

Thanks
