Can I reapply after the refusal in 28 days?

A legal adviser told me that I have 28 days to make a fresh application from the UK after my refusal.

I told them that I am switching from Tier 4 to Tier 2 General and my visa is expired in January 2013.

They still say that I have a right to re apply from UK.

Are they right?
I thought i need to go back to my country and re apply from there cause I am switching from Tier 4.

Any ideas?

Sorry I didnt mean to bother anyone. It is just I kept having new questions as I proceed in this situation and try to give the right decision.. Hoping not to post any other questions for now.
