Currently a Tier 4, applying for unmarried partnership

Hi there guys.
I've been lurking in this forums for a while ever since I've decided to apply for the unmarried partnership visa (Tier 2 ?) within the UK, and I would like to thank the community for your help - I've gathered quite a lot of information and confidence to apply for my visa. I just have a few questions that I couldn't quite find it myself and would really appreciate some help. I have tried to be as informative as possible so hopefully it would help - apologies if its a wall of texts.

I have been in an relationship with my girlfriend (Spanish nationality - EU national) for 3 years and been together studying in the UK for more than 2 years. Based on my assessment I have no problem showing proof that we have stayed together in same addresses (moved 3 times together in total) since we have all the bills, bank statement addresses, and contract + additional documents such as photos, letters, etc.

Problem is the proof of income.

so first of all, my partner finished college earlier than me and started working as a part-time worker and a self-employed piano tutor.
She did made about ~1000 a month (give and take) and been working like this for 9 months.

I've been still studying (even now) and will finish my studies at April and my visa finishes at April 21st.

I had no income from any work besides my financial help from my father outside the UK (being a student and all, I had no option to work really), and I have been withdrawing the money from my bank account outside of UK and been making deposit to my UK bank account. From this bank account I have been using it to pay for my tuition fee and my rent, bills, etc.

My question is,

-Can I show my proof of 'income' even if I was never employed and earned nothing besides my financial help?

-Can we both combine our 'income' to show proof that we have been making over 18600 pounds for the last 12 months?

-and Lastly, will my situation be counted towards the "Non-employment Incomes" under the 6.1. Category C of Annex FM Section FM 1.7? This is the Financial Requirements guide from the UKBA.

If I can apply for the unmarried partnership visa I am planning to extend my studies in the UK and apply for an university by next year. I made this decision because, since my partner and I have been staying together for more than 2 years within the UK, why not apply for an unmarried partnership instead of going back to my country and apply for another student visa. It would help me immensely since I wouldn't have to go back again and wait until I get a student visa to come back to the UK.

It's not possible to make this switch. You can only do this by applying from your home country. However, you seem confused; if your GF is Spanish it's unlikely she is a T2 migrant.

when its not possible to make this switch does it mean that I cant apply a new visa within the UK? or does it mean my student visa cant be changed into a unmarried partnership visa.

What I am currently trying to do is to apply for a new visa for me to stay within the UK. Does that still mean I have to go to my country to apply for one?

Why do you think your partner is a T2 migrant? Where is that information coming from? How long have you actually lived together?

You, yourself, suggested that she was a T2 migrant when you said that would be the category of dependant leave into which you intended to switch. However, it seems she is an EU national. What does she do in the UK; work, study, self-sufficient?

I apologize for the confusion; yes shes a EU national. My GF is currently working as a freelance/part-time/self-employed.

oh and yes she currently has no problem supporting herself on her own.

I did not ask if she could support herself; I asked what she does. Does she work, does she study, or is she self-sufficient on income garnered by your or from savings or other non-earned sources.

I am not sure what I've missed answering your question.

I've said that shes working at the moment (shes teaching piano lessions, doing part time job at a restaurant, and freelancing film composer). Shes getting paid working in the UK.

If she can provide proof of her employment and/or registration as a self-employed person, then you may apply for an EU residence card using form EEA2. You will also need to provide evidence of your durable relationship akin to marriage. The nominal (best suggested) period for the scope of the relationship evidence should be two years.
