Hi
I hope that s right place to ask this question. I (Pakistani) live in Cyprus and my Mrs is British we have been married for five years and I have Permanent Residence Card of Cyprus for Five years recently i got UK family visit visa for two years but now we want to move to UK for good. do i need to apply for EEA Permit in Cyprus or i just go to UK and apply it there. really i am looking for easier way as i hate immigration matters.

I assume you want to move with your wife?

What has she been doing in Cyprus? Did she work? She is required to work in another EU state before returning to the UK if you wish to use the EEA route.

If she qualified to use the EEA route, I suggest you first apply for EEA Family Permit as it will help you making sure you have all the required documents before leaving Cyprus (as you will need the same documents for future applications in the UK). EEA Family Permit also allows you to work (if you want to have a proof of your right to work in the UK).

Yes we both are thinking to move to UK and both are working here in Cyprus with all legal requirements and paying all relevant taxes.
So it's better to apply for EEA Permit in Cyprus rather going to UK and applying it there?

In case of Surinder Singh (British citizen returning to the UK), I think it is better to apply for a EEA Family Permit before moving back (even though you can enter the UK using your existing visa). The main reason is that it would help you to ensure you got all the required documents while you are still abroad rather than trying to obtain them from the UK (in case you have missed something). The EEA Family Permit should be issued in 2-3 weeks

Once in the UK, you can apply for a 5 years Residence Card using the same evidence you used for the EEA Family Permit.

The only question am concerned about, is even though my wife is British citizen and we have lived in Cyprus of five years and I currently hold two years visitor visa. Do I still have to apply for EEA (VAF5) in Cyprus, so we can settle in UK?

Ps On EEA Permit form I didn't see under the category EEA nationals, British citizen
