12 consecutive months out of 15 months - when does it start

Hi there,

I was wondering if I am going to apply for my indefinitely leave to remain on my existing Tier 1 rules, and that if I need to submit 12 consecutive months out of 15 months - does this mean that I can submit income dating back from Nov 2012 if I am going to submit my application in Feb 2012?

Also if my visa expires in Feb? What's the earliest that I can start the application? Jan 2012?

It's the fifteen months immediately prior to the date of the next application.

So if I want to apply on the 11-Jan 2014 via PEO, the 15 months will be 15 months up to 10-Jan 1014?

Yes.
21. (a) for all applicants the period for assessment of earnings must:

(i) consist of no more than 12 months which must run consecutively, and

(ii) fall within the 15 months immediately preceding the application.

Surely this is incorrect? You need to be on the anniversary of 5 yrs in London after initial grant/entry.

So if I entered the UK on the 2-Feb-2009, it would be about 2-Jan-2014 when I can apply first.
