Changing My Spouse (URGENT ADVICE NEEDED)

Post by dandy345 » Mon Mar 18, 2013 3:43 pm

BACKGROUND: I came to UK as a student on 1 Jun, 2006(Almost 7 years now and I haven't been to back home in last 5 years) My last Visa was a PSW which finished on 24 JAN,2012. I got married to a British Citizen in Aug 2012 so I applied for a spouse Visa in Dec 2012.
I'm married for about 6 months now and I just got my first 30 Months spouse visa. The situation is such that me and my wife were kind of made to marry each other by our families against our wishes(Perhaps). So consequently we are not getting on with each other and a divorce is always on the cards. I have been in a relationship with another British lady for 3 years and we both want to marry each other once all of this is over.

QUESTIONS:
1:AM I ENTITLED TO A FINANCIAL SETTLEMENT INCASE OF DIVORCE ?
2:CAN I SWITCH MY SPOUSE INCASE MY WIFE APPLIES FOR MY VISA TO BE CURTAILED AND WHAT IS THE PROCEDURE TO GO ABOUT IT?

I thank you all in Anticipation and will appreciate any help and advice.

1. Unlikely! Consult a family law solicitor.
2. Under UK law you can't divorce until you've been married for at least 1 year.
If you separate your current visa will be invalid. To apply for another spouse visa you would have to leave the UK and apply from your home country.
