Hi all,
My wife applied for Indefinite leave to Remain in May 2012 and submitted all the relevant documents including the Life in the UK test.
Unfortunately-and inexplicably-we applied on the Further Leave to Remain form which saw a refusal as she hadn't the ESOL test.
We will appeal the decision saying that the removal notice is technically unlawful as she has the right to Indefinite Leave to Remain, having had the Spousal Visa 2 years before applying.
This mistake we made is silly beyond words. Nonetheless, we can't (!?) be the only people to have made the same mistake.
Does anyone have the same/ similar experience of have heard of the same experience?
