When can i apply ilr for work permt

When can i apply ilr for work permt

1st ilr has been refused due to the gap of year 2007.
Work permit stamped:16/10/2005- valid until 30/01/2011

I'm going to apply 2nd ilr :
Visa: 04/11/2008-04/11/2013

Which date should I based for the 28 days rules which they are under the same category.

Is anyone here can help me make clear of this?
