Tier 1 (General) Rules confusion

Post by Omert » Tue Mar 19, 2013 2:47 pm

1- I originally applied for my Tier 1 (General) on 28th March 2010 (before the rules in place as of 6th April 2010). But i got the visa on 22nd April 2010 (after the rules in place as of 6th April 2010). Can some one tell me what rules apply to me?
I am going for apply for a Tier 1 (General) extension but confused about the rules.

2 - Also on the PBS Point Summary calculator, it asks about the date of 1st Tier 1 (General) successful application, which in my case was 22nd April 2010, when i enter that it automatically calculates the points as per the rules in place after 6th April 2010.

You applied under the rules in place as at the 28th of March.

Use the help function if you are confused: Enter the date you first successfully applied under Tier 1 of the points-based system. So the date you first applied for your visa was 28 March 2010.
Do not send me PM's with specific questions - post question in the open forum so others can also benefit from the answers.

Omert, I have the same 'problem' - I applied on 24 March 2010 and my visa is from 13 April 2010 so I enter 24 March 2010 as the date of application. I have a payment receipt to prove it as well, but I think you should be ok even if you don't have a receipt...my understanding is that you got 3 yr visa before 06 April 2010 and it changed to 2 year visa after...and my initial visa was issued for 3 years...!

Thank you guys,
As per the help section on point based calculator it clearly says the date when you first applied for the Tier 1 application.

I have one more query relating this topic: what does this below line means mention in section J7 for the PBS main applicant.

"Applications for leave to remain where you have, or have had, leave as a Highly Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General Migrant under the Rules in place before 6 April 2010, and have not been granted leave in any categories other than these since 6 April 2010"......Does this apply to me since i have applied before 6th April 2010????[/b]

This means if you have visa that was applied under rules before 6th April 2010 and since then you have no new visa issued of what ever the kind than you come under the rules before 6th April 2010.
In between, why you need calculator, no body bothers about it. I went peo last Monday haven't put calculator result in my file no body bothers.

I would advise you to stay simple avoid calculator, they have all your records and can see when you got visa and under which rules. You should be clearer on what you claiming though!!
