ILR Days Calculation

Hello there,

I am on Tier 1 General Visa (three+two) and also got HSMP approval letter, my ILR due on 7 DEC 13 End. I came in this country on 20 DEC 2008 and went back home on 17 JAN 2009 (after 17 days), after that finally I came on 1st may 2009 (more than 100 days).
after that My absences are as follows

Year 5 40 days(annual paid leave) (2012)
Year 4 21 days (annual paid leave) (2011)
Year 4 6 days (annual paid leave) (2011)
Year 3 0 (2010)
Year 2 15 days (annual paid leave) (2009)
Year 1 102 days (Bank account was opened from day one) 2009

Total 184 days of absences from the UK in the 5 year period. I would like to know if I will be applicable under the new rule from 13th December 2012 where 180 days for any continuous period of 5,4,3,2 years is mentioned. Also, it says if there is a 180 days or more absence in a year then it will be a problem.

Will there be any problem regarding absences in my case.
Or should I should apply for another extension Please help.

Regarding absence No problem at all. you can apply 28 days before the 20th dec 2013 if you fulfils all other requirements. You need to provide a letter explaining your absence and evidence if any applicable, for the remaining paid leave you need letter from your employer.

HI,

I do not have any proof of employment for 102 days form 17 JAN 2009 to 1st may 2009 (more than 100 days).I was working in India.

in starting I was more the 100 days out side the country,please advise is there is any clause that you should not be out side the country 90 days continues.
pls advise.

I can apply for PR or for extension there is gap of 102 day continues in starting.

pls help
