Can claiming child tax credit affect leave to remain in UK

Post by akierczak » Wed Mar 20, 2013 4:15 pm

Hi there!
My name is Meg and I come from Eastern Europe. I've lived in the UK for 7 years now. I have a child and recently applying for child tax credit. I live with the father of my child who comes from Africa who have limited leave to remain in the UK. I've filled form for child tax credit jointly with my partner but he does not want to sign it claiming that it will affect his future leave to remain in the UK (may be refused because of claiming child tax credit)
Can claiming child tax credit affect being granted leave to remain in the UK.
I would be grateful for any comments.
Many thanks Friend!

I take it you have PR and your partner has flr(m) or discretionary leave to remain? Your partner is subject to immigration control and cannot claim public funds but you as long as not subject to immigration control/right to reside test can claim child benefit and you can make a joint claim for tax credits (indeed you must), inform the HMRC that your parter is subject to immigration control. If he doesn't believe you get him down to the citizens advice bureau and they can tell him.

Thanks for replaying to my question. I am very grateful. It's so great I found this group. There is lots of new things in my life because me my partner and our child are family now. Immigration issues are complicated. Sometimes I feel overwhelmed with things I have to deal with now. But thanks to people like You I can learn. Anyway, my partner decided to sign the form. We see whats gonna happen. I called tax credit helpline but they said they cannot give iformation concerning immigration issues and I shuld sign the form. Once they receive it they can examine the case and tell me if I can receive tax credit. Interestingly, 2 years ago I applied for child benefit. They refuse me at that time claiming I had no right to reside in the UK which was false cause I come from EU. So I left it that way. Some time later my partner persisted I try again and after filling in two 20 pages forms I was granted child benefit although nothing has changed since then. Who knows what is gonna happen to child tax credit case...Also some friends told me: why dont you claim as a single person and you have no problem. Yeah I may not have a problem now but this against the tax credit law so I decided to follow the truth. I hope I will be worth it.
Again many thanks dear Friend!!! U were very helpful XXX
