Going abroad with a baby born in the UK but without EEU pass

Hi,

My wife has a non-EEU passport with a residence permit valid untill May 2016, our new born baby (born in the UK) for now has only non-EEU passport.

My wife is planning to travel to her country with our baby.
Now, will there be any problems for my wife to re-enter the UK with our daughter provided that the baby's passport is non-EEU and has no visas/permits in it?

Is the baby a visa national or not?

If a visa national, the baby will need a EEA Family Permit or might be denied boarding to the flight.

If a non visa national, then he should not have an issue to board the flight. Armed with a birth certificate (to show family relationship to you), a copy of your EEA passport, a proof of treaty rights (recent payslip for example), then he should be able to seek entry as a family member of EEA national and should be issued with a Code 1A entry stamp in his passport (for 6 months).
