Family member of an EEA national;EEA4

Post by Help needed » Thu Mar 21, 2013 11:10 pm

Hi,
I would very much appreciate your advise here.

I am married to an EEA national for almost 3 yrs..have 2 kids with British passport. I am on a Family member if EEA national visa.
My wife has been in uk for 12 yrs.worked until dec 2012.
My question is: will I be affected by the fact that she stopped working 4 m ago?if yes what can be done Asap to fix this?
She automatically became a PR 5yrs of continuous employment here...back in 2007,does she still have to excercise TreatyRights in order me to e here lawfully? I am working and earning quite ok amount of money...the fact she is a PR does not exclude her from treaty rights requirements?
SORRY I am worried I dnt want this to affect my PR app in future.

Your help is highly appreciated.

Thank you![/i]

As you already aware that 5 years continuous employment leads to an automatic PR for EEA national then beyond that time an EEA national is no longer required to excercise its treaty rights.
Please donot send PM. Write in open forum to facilitate others too.

Hi
No it will not effect your application for pr, in fact if your wife apply for bc which she will get in 1-2 months then u can apply for pr on the basics of spouse of British national and u don't need to wait another 2 years, good news for u!!!
I hope one of guru will put some more light on this

Hi,

I undertand that now you need to show that you excerse treaty rights and it should be dashown on ur app for PR (EEA3) ... I am confused
My wife has a residence card with no expiry date, is it the same as PR for EU nationals?

She has been out of work for almost a year.now, so if she applies for PR she will be refused? I would appreciate your comments.

Many thanks
