FLR (M) application with benefit

my borhter in law is a british citizen with 3 kids under 18 all british except hir wife (house wife not working) who is unfortunately on a route of 10 years human right visa due to not passing her life in the uk test in time, now she has passed this stupid test but need to apply her first extension of 2/1/2 year under flrm application towards her indefinite stay under new rules passed in july 2012.

problem is her husband is earning about 19k gross which is ok under new rules of income threshhold, but with this income due to his kids he is getting some child tax credit & working tax credits as well alonwith some housing benefits...can these benefits effect his wife's flr (m) application. becuase with this income he is eligible to get these benefits as he is getting now...pls note in the benefit forms he has declared hmrc & council that her wife is still in immigration control...mean to say he is not hiding anything with benefit agencies...is it ok to get these benefits?
