Indefinite Leave to Remain SET (M)

Post by kalmefrnd » Tue Mar 26, 2013 10:33 am

Hi,

My husband got his British Citizenship 3 months back. I entered UK 2 years before as a dependant and I am now able to apply for ILR under SET(M), Application for Indefinite Leave to Remain In the UK as the partner of a person present and settled in the UK.

I have certain queries and doubts to complete the application. Kindly help me clarify the below doubts :

1) There is a question which says when did you last see your partner?

Since I stay with my partner and I see him everyday before he leaves to office and come back from office, what would be my answer to this question?

2) They have asked me to give details about when my finger prints were taken last for Biometric Residence Permit. Since I do not remember the exact date, can I provide the month and year?

3) In section 11 under documents they say that :

we need 6 letters or documents addressed to the applicant or jointly in both partners names. The dates of the letters or documents should spread over the whole 2 years. They should be from atleast 3 different sources.

In this case I have only council tax bills from last 2 years which is in my name and the rest of all the documents life electricity, telephone, bank statements are in my husband's name. Can I submit only council tax bills for last 2 years ?

Kindly help me with these doubts.

Thank u

1. I put "Everyday" as my answer.

2. I just checked the form to recall what I put. I gave the month/year, not the exact date.

3. They want a range of statements - do you have any letters from your GP or anything NHS related? Do you have any private coverage (I submitted a letter from BUPA)? I submitted 2x NHS related for myself, 2x gas bill in joint name and 4 others in my husbands name (council, HSBC, BUPA, water).

Set m timeline

Post by Pheena » Tue Mar 26, 2013 9:14 pm

Hi all
this forum has been very helpful so i would like to share my timeline
pleas bear with me because its quite lengthy

23 may 2012 - submitted my application (SET M)
4th June 2012 - acknowledgement letter received
25 July 2012 - Biometric letter received and i enrolled my biometrics same day
7 Aug 2012 - Biometrics letter sent again this time with a different reference number (i also enrolled my biometrics again again)
21 Aug 2012 - Biometric letter sent by UKBA for the third time with same Ref number with the last one but this time saying that they haven'T received my biometrics... dont know why so
24 Aug 2012 - ENROLLED MY biometrics FOR THE THIRD TIME

then the actual waiting game began...
initially i wasnt too worried until it became apparent from the timelines that i seem to be the only SET M applicant that had not got any reponse from the UKBA
Dec 2012 - i made a call and was told that my application was still in progress and all i could do was wait until i heard from them.
i then went on to request my husbands passport becase he needed it urgently but nothing came
i wanted so much to get a lawywer, or use the MP, or try somthing if i really thought it would make a difference but i didnt do anything but trust in God being a christian.

03 mar 2013 - my hub passport was delivered alone
16 mar 2012 - other documents received + approval letter
21 mar 2013 - BRP delivered (delivery man didnt even take any ID)

i am over the moon even though its been the most stressful 9-10 months of my life.
i have always believed that you cant be overly confident on documents sent or genuity of application when it comes to the ukba.
with them anything can happen and you have no choice than dance to their tune
the baby i had in June 2012 is almost walking thats how long i have waited yet am grateful to God that at the end of it all i got the approval because a friend of mine wasnt that lucky he was rejected for no just cause and had to go through court and appeal which he won

so please keep faith and thanks to everyone in this forum for me God perfected everything that concerned me.

Documents

Post by Pheena » Tue Mar 26, 2013 9:18 pm

@ lolainkent

am not an expert but i just went through same process.
though approval was delayed i guess due to biometric enrollment but ukba didnt ask me for more documents and i got my approval etc

the documents i submitted were:

proof of financial capability: (separate names)
1 - bank statement (applicant and spouse)
2 - Payslips and P60

3 - Mortgage statement (proof of accomodation it had both our names on it) if you dont own your home then get your rental agreement contract

More proof of co-habitation:
4 - Medical cert (NHS card) and/or letters including GP letters (applicant and spouse)
5 - Voters Register letters
6 - Credit card and store cards statements
7- council Tax bills
8 - TV Licence

Other Bills provided:

British Gas Electric bills
British Gas, Gas bills

very important that all this documents are spread from the time you had your last leave to remain (2years) mine was spread from DEC 2009 - May 2012
ie gas bill dec 2009, gas bill 2010, gas bill statement 2011 and 2012

you need 6 documents each if its separate names
but 3 if the documents have both your names
but the safest bet is to provide as much as you have
so that they wont need to ask you for more
try also to arrange orderly and neatly

i hope this gives you an idea
all the best
