Refusal of Entry Clearance - Application under Paragraphs 41

Post by MonikaNazifa » Tue Mar 26, 2013 4:33 pm

Dear All

My friend mother was visiting UK for the last 35 years every year. Her husband has successful business here but he died in 2007. She is an owner of 25% flat in London. In the Bank she holds over £ 10,000.00
She comes and goes regularly as she own the house in Egypt too. January 2013 her last visa finished. She went to apply to British Embassy in Cairo but she couldn't do it anymore with Officer. As she doesn't read or write English she asked somebody for help with application. Now she got refusal of entry clearance as the information the man put in were just rubbish. Not true.
For example he put that she never been in UK before.
How can she appeal against the decision.
Her right to appeal are limited to the grounds referred to in section 84(1)(C)
Any advise what she can do now ?

I'm speechless that someone can be so stupid. Was it her butcher or her milkman that she asked for help, rather than a compete immigration professional?

She has no right of appeal if it was a general visit visa. She should apply again but with a very detailed explanation of how this woeful situation came about. I suggest she hires a UK-based reputable firm to sort this out as, otherwise, she could face a ban for having given false information in a previous EC application.

Thanks for reply. She is 74 years old and never had trouble before to come here. She always was grounded with 5 years visa so was coming and going free. Few months in Egypt and few months UK.
So do you suggest she starts with new application and just attached all the documents like: Bank Statement, Flat lease and her previous visas, plus explanation letter ?

No, I don't. But I do suggest you read what I actually said.
