ILR - Spent/Unspent Conviction

Post by velukurthi » Thu Mar 28, 2013 1:19 am

Hello All,

Once again back with a new query, I hope you all will bring me out of this uncomfortable situation with all you valuable advice.

In 2012 i had a parking penalty from the council which was lost in the post as the due date for payment passed council obtained authorisation from court to collect teh debt and passed to baliff.

When i appealed to Council they had accepted my appeal and cancelled the penalty.

Is this going to affect me on my ILR which i am planning to apply in June 2013.

does the above situation will be considered as spent or unspent conviction or is it treated as a conviction at all ?

All your valuable replies will be much appereciated.

Thank you

Velukurthi

From what I can see, court was never involved. Coundil don't have to go to court in order to pass the file to bailiffs.
You're in clear.
Goodluck.

Hi [iD]

Council did went to court to obtain court authorisation to collect the debt
and passed the same to baliff.

But there was no case , no hearing etc...,

Even i called the court helpdesk with the penalty numbers to find out if there is any case pending but they said ther was no case filled.

thank you

When the court is saying no case was filed then there isn't a case. You might wanna check your CCJ report just to be on the safe side.
Goodluck.

You look fine, get a CCJj report and try and be sure,
You can definitely work around this one, isnt a major issue,

It is accurate if there is not one there then no ccj. Again my first response to your initial question was No.

If any case is not registered against you ,then you should not be worried. Member has been good enough to give you the Trust online web address. Now you have checked and also you could go through other Customer's Experiences,on the website.
