Tier 2 ICT to Tier 2 dependent

I have a Tier 2 ICT long term visa and will be moving to UK in May.
My fiance currently works in London on Tier 2 ICT short term staff migrant visa. Her visa expires in Jun 2013. Meanwhile she has quit her job and returning to India in Apr. Her current employer will cancel the CoS. She will apply as my dependent after marriage in May. Is she eligible to work or 12 months cooling off period apply?

after marriage she can apply from India for a PBS Dependant visa without any cooling off and can work once she is in the UK.
