ILR for Tier1 dependent after 2 year and new 5 year criteria

Post by jeeboo1046 » Fri Mar 29, 2013 12:04 am

Hi, I came to UK on 2 yrs hsmp and then got extension for 3 more years in tier1 general. My wife came here on 27 april 2011. I applied for my ilr on 26 july 2012 and also sent spouse application and filled flr(m) form, both were sent in one envelop. I got ilr on 24 feb 2013, and on 26 feb 2012 received letter from ukba asking for more documents for my wife's extension along with my ilr brp card. My wife got her extension on 22 march but there is a problem.
ukba has given 2 and 1/2 year extension along with a letter stating that she will apply for ilr after completing 5 years.
we hsmp+tier1 people have a rule that our spouses get ilr after 2 years, does change of rules on 9 july 2012 also apply to us and our spouses should apply after completing 5 years???

I think that they made a mistake. The transitional provisions should have been applicable.
