Please can I have some help or directions

Hi,

I am not sure if this is the right forum, but I am hoping someone can help or point me in the right direction.
Basically my sis got married a year ago to someone in india, one year on and she is now separated and has a child, she is British and she cancelled his fiance visa and had his passport returned to him but he will not leave the country so he is an overstayer, and he has asked for child access which allows him to stay in the uk indefinitely according to our solicitors.
He only married my sis so he can get a British passport and then move in with his girlfriend whom he was seeing before he married my sister. And we have a recording of him confirming to his girlfriend " let me get my British passport and then I will leave her and forget about the child, I dont want it".

Can we do anything about this and send him back, he is physically abusive as well and the police are looking for him but cannot find him but he is attending the child hearing case next week. According to our solicitors they say the judge will allow him access to the child and this means he can stay in the uk.

Please help.

If the judge deems it fit and proper to grant contact, then he has every right, under UK law, to apply to remain in the UK with rights of access to his child. Pretty much for the same personal rights reasons that permit your sister to marry another perfect stranger and bring him to the UK. Or would you like a law that prevents one but not the other?

I dont understand, what do you mean stranger? My sister knew him and spent time with him in india and also he has been in the uk as a student before my sister married him, so you should check your facts before making such remarks.
