When you have transitional protection the pre July 2012 rules apply which requires 2 years flr(m) prior to ilr there are also no specific income rules. Where the person has no transitional protection the new rules apply from July 2012 which requires 5 years flr(m) for ilr and also requires specific income I.e. around £18k per annum gross for a couple with no dependant children.alsanober wrote:Hello Guys, i have got a question to ask, if i may
I applied for spouse visa on 25 Feb 2013 and was granted spouse visa on 21 Mar 2013 and i got my BRP card on 25 Mar. I switched from Post-Study Work visa to spouse visa. I entered UK last time on 22 April 2012.
I got my documents a day after with my passport and all the documents. In that package there is a letter giving some information about public funds and all. It also says that i can apply for ILR after two years provided i have stayed in the UK for 2 years.
Now the rules were changed where i would have to spend 5 years to get ILR, so why does that page say 2 years rather than 5 years.

I am really not sure if i have transitional protection or no. I was on Post-Study work visa like i mentioned before. Transitional arrangements are listed here http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary if you are not mentioned as once of the protected groups then you are under the new rules. The reason 2 years will be quoted is because 2 years is given then you apply again and a further extension is given until you have reached 5 years and can apply for ILR (or possibly longer if for example you are not considered of good character).alsanober wrote:I am really not sure if i have transitional protection or no. i would have thought so but i am confused because it says on that leaflet that i can apply after two year using SET (M) form and all. it tells me what form to use and how to apply ILRD4109125 wrote:alsanober wrote:You are on the new rules as you were not on the family path before July 2012.
