HI

If the Gross income is less than 18600 -- income is 16K -- £2600 short

Do UKBA take into account any savings ?? Do they offset the savings against the income?? If my cash savings is £35k do i have a chance of spouse visa--

help would be apprieciated

The amount of savings required in lieu of income is:

16,000 + (The shortfall from 18,600 x 2.5)

In your case you would need 22,500 so it seems you will qualify if you have held that sum for at least six months.

does this change if the money is a gift? and how did you get 22500?

Simply substitute your shortfall of 2600 into the calculation.

It would help you greatly if you actually read the financial guidance as that is much clearer than my illustrative examples.

the reason I asked the original question is because my spouse visa got refused because the 18600 limit was not met-- my situation is as follows: I have 3 incomes 1) employed £8000 2) property income £6000 3) self employed income 3) 10000 (gross before all expenses) £2000 after all expenses...
ECO refused because of in sufficient evidence for self employment.. (I didn't provide self assessment return or the amount of tax paid) I can get these for tax year 2011/2012... I will have to appeal and send these documents also can I send 2012/2013 tax returns that show a higher gross e.g £4600 after expenses - that will cover the £18600..
In short the ECO was satisfied with £14k income but there no mention of my £35k savings in the decision notice..When I appeal can I mention that savings have not been taken into consideration...

Your problem is that you claimed self employment ...
(f) Where the person is self-employed, they cannot combine their gross annual income at paragraph 13(e) with specified savings in order to meet the level of income required under Appendix FM.

Even though i have an employed job aswell as self - employed.. they will still not take into consideration 35k worth of savings??

If you hadn't claimed self employment - they wouldn't have invoked that rule and ignored the savings ... but you did - so the rule kicks in.
